1. Scope
These terms apply between nemox GmbH, Prielweg 5, 88131 Bodolz, Germany (“nemox”, “we”) and you when you use the nemox connector (MCP server at app.nemox.ai/api/mcp) and the related sign-in to request and book freight quotes from freight forwarders.
nemox is offered to businesses only. By using it, you confirm that you act for a business and not as a consumer.
2. What nemox does
nemox passes your requests to the forwarders you choose and returns their offers to your assistant. nemox is not a freight forwarder or carrier and does not become a party to any transport contract.
Every offer comes from the forwarder. Any contract for the transport is made only between you and the forwarder, on the forwarder’s terms (for example the ADSp for many German forwarders).
3. Access
You sign in with your business email address and a code we send to it. Each forwarder decides once whether to accept you as a client; nemox has no influence on that decision.
We may refuse or end access, in particular if these terms are breached or if requests show no real buying intent.
4. Quotes and bookings
Prices, validity and conditions are those stated in the forwarder’s offer. nemox does not guarantee that a forwarder will quote, that an offer is available or that it is complete.
A booking through nemox is a booking request to the forwarder. It reserves no carrier space and takes no payment. It becomes binding only once the forwarder confirms it to you.
Your assistant asks you to confirm before it books. AI assistants can make mistakes: check the shipment details, the offer and the forwarder before you confirm.
5. Your obligations
Give complete and correct shipment details, in particular on dangerous goods, temperature control and cargo value.
Only send requests you actually intend to ship. Do not collect prices in bulk, resell them, scrape the service, work around its limits or use it to compete with nemox.
Keep your email account secure. You are responsible for everything done with your sign-in.
6. Your own AI agents
You may connect your own AI agents through the same address once they have been approved. You are responsible for their requests and bookings as if you had made them yourself.
7. Fees
nemox is currently free for shippers. If we introduce fees, we will tell you in advance, and they will only apply once you agree to them.
8. AI assistants
Your AI assistant is provided by a third party (for example Anthropic or OpenAI) under its own terms. nemox is not responsible for the assistant or for what it does with your input.
9. Availability and changes
We work to keep nemox available but do not guarantee uninterrupted service. We may change, limit or discontinue features.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
For slight negligence, we are liable only for breach of an obligation that is essential for the proper use of nemox and on which you may rely, limited to the damage typical and foreseeable for this kind of service. Otherwise, our liability is excluded.
We are not liable for the offers, services or conduct of forwarders, carriers or AI assistant providers.
11. Privacy
How we process personal data is described in our privacy policy at nemox.ai/privacy.
12. Changes to these terms
We may change these terms. We will tell you about changes by email at least four weeks before they take effect. If you keep using nemox after that, the new terms apply; if you do not agree, you can stop using nemox.
13. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the registered office of nemox GmbH.
If the English and German versions differ, the German version prevails.
